While everyone wants Women and Children Protected from Violence. Ordinary people are also being persecuted by irrational decisions made by our courts in Intervention Order cases.
Steve's is a typical case, even though he has never harmed his only child or her mother, and he has never threatened them, a court has barred him from seeing his daughter for seven years. Steve's wife has twice raised sexual abuse allegations which have been proven false after months of investigation. Steve has been barred from seeing his daughter because his wife has said she would be emotionally "shutdown" which would affect her parenting skills. Steve rightly believes that intervention orders are being used as weapons in child custody battles and are being used to persecute men and remove fathers without there being any violence at all.
This is typical of the type of Gender based decisions made by the Courts. Men are deemed uncooperative if they buck the system, and pay the price for complaining. This year Steve approached his ex-wife's new partner to see if there was any chance of mediation that would allow him to see his daughter. His wife instantly launched legal action claiming he was breeching the intervention order and the court believed that his very polite conversation represented harassment, even though the court has accepted that he is of Good Character.
This is not "Criminal Prosecution" it is more like "Criminal" Persecution just because a father wants to have contact with His daughter. This is Typical of the Intervention Order Madness that happens regularly in Our Courts. A County Court Judge said he disapproved of Intervention Orders being used as weapons in Family Disputes but in far too many cases that is exactly what they're used for, and you don't need to commit a crime anymore to be considered a criminal, all you need is a vindictive ex family member with an Intervention Order, and you could be hounded for the rest of your life with the possibility of ending up in Jail, all they have to do is go to the Court and say they want the order to continue and there's nothing you can do about it.
It is Obvious that women are using Intervention Orders as a substitute for child custody reasons. Instead of waiting for child custody issues to be heard by the Family Court. It is much easier and a lot Quicker to get an Intervention Order. In one such case, a woman applied for an Intervention Order and the Husband wanted to Contest the Final Order. This was just before Christmas and The Wife's Female Barrister said to the Husband, you're going to have a very lonely Christmas. This meant that if the husband didn't immediately consent to the order without admission, he wouldn't see his children at Christmas because the contested hearing wouldn't be heard by the Court until after Christmas. This is a very mean way of manipulating Intervention Orders for your own Advantage and not for protection from Family Violence.
The defendant in this case faced $1500 in legal fees but still wanted to contest the matter, the Magistrate then said to the defendant, not being within 200 metres of your wife's address is not really going to affect you is it, and you're not going to harass or intimate your wife, and surely there are other things you could spend $1500 on. This was just another way for the Magistrate to short circuit the justice system by trying to persuade the defendant to consent to the order, without making any admissions to the court. The magistrate looked frustrated and sighed then turned to his clerk to allocate a date for the contested hearing. If the Magistrate was convinced that the defendant was not going to breech the conditions of the order and was therefore no danger to his wife, then why issue the order in the first place??.
A father was arrested for leaving Christmas presents at the door of his Children's home on Christmas Day, he received a 3 Month Jail Term for his troubles. These Draconian and discriminatory laws have led to more fathers taking their own lives; they also say 1.5 Million uncles, aunts, cousins and grandparents are also being denied access as well. Unfortunately much of the legislation relating to family law and intervention orders are being generated by radical anti-male propaganda and hysteria, which misguided politicians believe is true and correct. It is no wonder father's groups are demanding a fair go, Barry Williams of the Lone Fathers association says the family law system needs an overhaul. That is an understatement, what our courts need is an urgent transfusion of good old fashioned Common Sense.
People should be prosecuted in our Courts because of Criminal Actions not because of their Gender. In the end, Bad Laws inappropriately applied does not make for Good Justice, which is obvious when you read Steve's Story.
